It's a "cold air" intake in that the cold air from the car moving is getting forced into the air box...the fact it isn't a straight through is to avoid water intake. Just putting on a metal tube that pulls air in lower doesn't really make a huge difference. The only real difference is in the MAF calibration which probably leans things out a bit over factory. I'd argue the "ram" effect is more beneficial than a open tube. The stock intake system is forcing air in at speed with more velocity than the engine will pull it in on it's own vacuum through a CAI tube. Also, with a CAI you are bringing your filter even closer to the road with an already low car, which can get soaked if you happen to go through some decent water, and when it's really hot out, the air just above the pavement can be even hotter than the air up high.
I have no doubt you will see a 10HP or less gain just through leaning out things via the MAF calibration, but real world I think it's not really something that will be felt. For example...the car is rated at 306HP with 87 octane, and 314 with 91. Go ahead and run 91 for a few tanks and tell me how much of a difference you feel. I'm not arguing the CAI has benefits, just that it always seems to be that it's the first thing people do like its the holy grail of performance, when in some cases, the factory intake system is actually better.
Just my .02....I realize that is probably not a popular opinion.

Sometimes I'm surprised people don't just put a filter on the MAF, or even better, right on the throttle body. That's more "direct" right?

Yes, please note this... also note as I said when this issue first arose. Injen will most likely address the issue. This thread also says INJEN is sending longer couplers to remedy the issue. Some "real tuners" on gencoupe figured this out before injen addressed it and spent the spare coins on there own longer couplers or had them in the garage.

I totally agree with you there. That whole intertwining muffler, conjoining pipes down low don't seem to match the theory behind maximum power increases. But I must compliment magnaflow for having awesome sound at such a low price. Also the quality seems (at least from vids) to be very good.
I'm lookin at the ARK when I get my 3.8 track this summer. The exhaust and intake will be my 1st mods along with audio upgrades.
